These terms govern use of the Wenvar website and the Wenvar register, provided by Wenvar Pty Ltd (ACN 701 739 700, "Wenvar", "we"). Using an account means agreeing to them. Questions to hello@wenvar.com.au.
The service
Wenvar is a site photo evidence register: a capture app and web register that stamps photos with the time and location measured at capture, files them to a project, and makes them searchable by the project’s members.
Accounts
Accounts are created by invitation and belong to one named person. Keep your credentials to yourself, and tell us promptly if you believe an account has been compromised. Project owners control who is a member of their project and can remove members at any time.
Your content
Your photos and records remain yours. You grant us the rights needed to store, process and display them to the members of the project they belong to, including generating suggested captions. You are responsible for having the right to photograph what you photograph, and for complying with your site’s rules on imagery of people.
What the stamp means
Time and location stamps record what the device reported at the moment of capture. They are not a guarantee that an image has not been altered afterwards, and Wenvar makes no claim of tamper-proofing, certification or admissibility. The register also stores each record’s provenance, so photos captured in-app and photos imported from elsewhere are always distinguishable.
Acceptable use
Do not use Wenvar to store unlawful material, to infringe others' rights, or to attempt to access projects or accounts that are not yours. We can suspend accounts that do.
Availability and support
We work to keep Wenvar available, and we tell customers promptly if something goes wrong. Wenvar is provided without a guaranteed uptime level unless one is agreed with you in writing.
Liability
Nothing in these terms excludes rights that cannot be excluded under Australian law, including the consumer guarantees in the Australian Consumer Law. Beyond those rights, and to the extent the law allows, our liability for a problem with the service is limited to re-supplying the service or the cost of re-supplying it.
Ending an account
You can stop using Wenvar at any time. We can close accounts that break these terms. When a customer’s use ends, we work with them on a reasonable export of their register.
Governing law
These terms are governed by the laws of Queensland, Australia.
